User Listing Agreement (Employees/Students)
This Agreement is made and entered into on _____________________ in Siliguri, West Bengal, India.
BETWEEN:
KaamKaaj (hereinafter referred to as "Kaamster"), a job search and career scaling company with its principal place of business in Siliguri, West Bengal.
AND:
The individual employee or student (hereinafter referred to as "User") who creates a profile and is listed on Kaamster's platform.
WHEREAS:
Kaamster operates an online platform that connects users seeking employment and career advancement opportunities with potential employers and relevant services.
The User desires to create a professional profile on Kaamster's platform to showcase their skills and experience for job opportunities and career scaling.
NOW, THEREFORE, in consideration of the mutual covenants and agreements hereinafter set forth, the parties agree as follows:
1. Listing on Kaamster:
Kaamster agrees to host the User's professional profile on its platform, making it accessible to employers and other registered users of the platform.
2. User Responsibilities:
The User warrants that all information provided in their profile is accurate, complete, and not misleading. The User is solely responsible for the content of their profile and its continuous accuracy. The User agrees to use Kaamster's platform in a professional and ethical manner and will not upload any offensive, discriminatory, or illegal content. The User is solely responsible for maintaining the confidentiality of their password and user identification and all activities and transmissions performed by the User through their user identification. The User shall be solely responsible for carrying out any online or off-line transaction involving credit cards / debit cards or such other forms of instruments or documents for making such transactions, and Kaamster assumes no responsibility or liability for their improper use of information relating to such usage of credit cards / debit cards used by the User online / off-line.
3. Pricing Policy:
No onboarding fees are applicable for Users creating a basic profile on Kaamster. However, some extra charges may be levied on additional services or premium features offered on the platform, the details of which will be clearly communicated to the User before availing such services.
4. Payment Policy:
If the User chooses to avail itself of any additional services or premium features that incur charges, the payment terms and methods will be specified at the time of opting for those services. The User agrees to abide by the stipulated payment policies.
5. Cancellation Policy:
Once a User opts for and pays for any additional services or premium features, there shall be no refund applicable upon cancellation of those services. The User may choose to discontinue the use of these services at any time, but no refunds will be provided for the remaining period.
6. Prohibition of Employer Fees:
The User acknowledges that Kaamster does not endorse or authorize employers to charge any fees from candidates as a prerequisite for application or employment. In case the User encounters any employer requesting fees at any stage of the recruitment process through the Kaamster platform, the User is obligated to notify the Kaamster team at hello@kaamster.com at the earliest.
7. Nature of Kaamster's Platform - No Guarantee of Employment:
The User acknowledges and agrees that Kaamster is solely a listing platform designed to facilitate connections between job seekers and employers. Kaamster provides a platform for Users to showcase their profiles and for employers to post job vacancies. Kaamster takes no guarantee or responsibility for the User being employed because of their listing on the platform. The entire recruitment and hiring process is solely at the discretion and responsibility of the employers.
8. Data Privacy:
Kaamster will handle the User's personal data in accordance with its Privacy Policy, which is accessible on the Kaamster platform. By creating a profile, the User consents to the collection, storage, and processing of their information for the purpose of facilitating job search and career scaling activities.
9. Intellectual Property:
The User retains ownership of the content they upload to their profile. By listing their profile on Kaamster, the User grants Kaamster a non-exclusive, royalty-free license to display and distribute the profile to potential employers and other registered users through its platform.
10. Termination:
Either party may terminate this Agreement at any time. The User may terminate by deleting their profile from the Kaamster platform. Kaamster reserves the right to remove any profile that violates the terms of this Agreement or is deemed inappropriate.
11. Disclaimer:
Kaamster provides a platform for job searching and career scaling but makes no warranties or guarantees regarding employment or career advancement opportunities. Kaamster is not responsible for the interactions or agreements between Employers and Users that may arise through the use of its platform.
12. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of India.

IN WITNESS WHEREOF, the User, by their agreement to create and maintain a profile on the Kaamster platform, signifies their acceptance of the terms and conditions of this Agreement.
